4 Easy Steps to PowerLIFT your advertisement!

Step 3 – Download the Start Up Work Order.
Credit card payment orders are transferred immediately to The Start Up Work Order download page. The Work Order provides all the information needed for starting your analysis. Orders requesting invoicing are emailed the Work Order download instructions after the invoice payment is received.

Step 4– Upload the Work Order and Advertisement
We will make arrangements for FedEX pickup service for delivery to our analysts in either Maryland or Connecticut. You also can upload or e-mail us data files.

In most cases, within 5 business days after receipt of the Work Order and advertising materials, you will receive the complete Ad PowerLIFT analysis.

Preliminary advertising that is not published or in proof form ready to print requires an additional charge of $250. Preliminary advertising is work in progress, such as concept statements, thumbnail layouts, comps, and copy text. Preliminary advertising is more expensive to process because the components are less clear and take longer to analyze.

Advertising PowerLIFT must be prepaid by credit card or company check.

The Advertising PowerLIFT work order, models and reports are proprietary, copyrighted Licensed properties. They cannot be published or shared with anyone outside the ordering company. License Agreement: The following shall constitute an agreement ("Agreement") between SmartPlans LLC ("SmartPlans") and "you," pursuant to which SmartPlans, through its website URL adpowerlift.com provides the Advertising PowerLIFT Package and certain analysis, reports, software and/or other products ("Product(s)") to you.

1. Upon acceptance of your order, SmartPlans shall provide you with the Product(s) ordered electronically via email or via other downloadable methods of distribution. SmartPlans grants you a non-transferable, non-exclusive, limited license to use the Product(s), subject to the limitations set forth herein.

2. The Product(s) is/are being furnished to you hereunder solely for your own internal business use. You acknowledge and agree that the product(s) is/are and shall remain the exclusive property of SmartPlans and that SmartPlans owns all right, title and interest in and to, the Product(s), including the copyright and all other intellectual property rights therein. You also acknowledge and agree that the Product(s) constitutes confidential information of SmartPlans. You shall not modify, distribute, transmit, display, publish, disclose, create derivative works from, transfer, sell or otherwise provide the Product(s) to any third party without the prior written consent of SmartPlans.

3. You shall reproduce SmartPlans's copyright notice on all authorized copies of the Product(s), as follows: Copyright © 2005, SmartPlans LLC. All rights reserved. This document contains proprietary and confidential information constituting trade secrets of SmartPlans and is being provided for your use only. No part of this product or the data or information included therein may be reproduced, republished or redistributed without the prior written consent of SmartPlans. SmartPlans makes no representations or warranties, express or implied, with respect to the product(s), the information contained therein or the results to be obtained by the use thereof. SmartPlans shall not be liable for any inaccuracies or errors in the product(s) or the information contained therein.

4. All orders must be prepaid. After payment, you shall complete the necessary information requested in an Advertising PowerLIFT Work Order to enable SmartPlans to provide you the product ordered.

5. Your satisfaction with the product is fully guaranteed. You are the sole judge whether the product is worthwhile. If you are unsatisfied for any reason you can receive a full refund, less a transaction processing charge of $100.00. The only exception is if you fail to complete the Work Order. If the Work Order and advertisement are not received by SmartPlans, 25% of the purchase price is non-refundable.

6. You shall pay the fee indicated by SmartPlans for the Product(s), which shall include all applicable sales and use and other taxes collected by SmartPlans in accordance with applicable federal, state, and local laws, rules, and regulations.

7. The Product(s) shall be provided to you "AS IS," without warranty of any kind. SmartPlans shall not be liable for any inaccuracies or errors in the Product(s). SmartPlans shall not be responsible for delays or failures in performance resulting from acts beyond the reasonable control of such party. SMARTPLANS MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE REPORTS, THE INFORMATION AND DATA CONTAINED THEREIN, OR THE RESULTS TO BE OBTAINED BY THE USE THEREOF. IN NO EVENT SHALL SMARTPLANS BE LIABLE TO YOU FOR ANY LOST PROFITS OR INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES, EVEN IF ADVISED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES. SMARTPLANS TOTAL LIABILITY TO YOU UNDER THIS AGREEMENT, WHETHER ARISING FROM TORT, CONTRACT, WARRANTY, NEGLIGENCE, OR OTHERWISE, SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO SMARTPLANS HEREUNDER.

8. All commitments are subject to acceptance by SmartPlans at its headquarters in Annapolis, Maryland, U.S.A.

9. You shall not assign or transfer this Agreement or your rights hereunder without SmartPlans prior written consent. The waiver by either party of a breach or violation of any provision of this Agreement shall not constitute a waiver of any subsequent breach or violation of such provision. Any amendments, changes, or supplements to this Agreement shall be null and void unless made in a writing signed by both parties. This Agreement shall be interpreted, construed, and enforced in accordance with the laws of the State of Maryland.
